Video/Photograph/Audio Recording Release Form
By replying with “Yes”, I hereby agree to grant e.l.f. Cosmetics, Inc. and its affiliates and third party vendors (collectively, “e.l.f.”) as well as its successors and assigns the irrevocable right and permission to use my name, social media handle(s), voice, and likeness (my “Likeness”) as depicted in the video, photographs, written materials, and other audio-visual recordings generated by me (the “Recordings”) in all forms of media for the advertising, marketing, promotion and publicizing of e.l.f.
I understand that I will not be paid or receive any form of compensation for agreeing to this release form.
I understand and agree that the Recordings may be edited or otherwise modified and may be used individually or in conjunction with other media in any medium (including without limitation the Internet and social media sites). There is no time limit on the validity of this release nor are there any geographic limitations on where materials containing my Likeness may be distributed. I waive the right to inspect or approve any such materials.
I also understand and agree that I may be identified by name, social media handle, and/or title.
I hereby release e.l.f. and its successors, predecessors, assigns, directors, officers, employees, representatives, agents and partners from any and all claims arising out of, relating to, or otherwise in connection with the use or distribution of the Recordings or any materials containing the Recordings, including any claims that remain unknown to you at this time. This is a full and final release.1
By replying with “Yes”, I acknowledge that I am eighteen (18) years of age or older at the time of consent and have completely read and fully understand the above consent and release and agree to be bound thereby. This release is binding on me and my heirs, assigns and personal representatives.
I hereby warrant that I am 18 years old or older and competent to contract in my own name or, if I am less than 18 years old or not competent to contract in my own name, that my parent or guardian has also signed below.
1 You agree to expressly waive any rights you may have under any law that limits the effect of a release, including California Civil Code § 1542, which provides that: A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.
